1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, organisation or authorised representative booking or receiving the services.

Company, we, us, our means Waste Clearance Maida Vale, the service provider supplying waste collection and clearance services.

Services means any waste clearance, rubbish removal, bulky item collection, garden waste clearance, office clearance, or related services supplied by the Company.

Site means the address or location where the waste is to be collected and where the Services are to be performed.

Waste means the items, materials, rubbish or refuse that the Customer engages the Company to collect and remove from the Site, excluding any items specified as prohibited or hazardous.

2. Scope of Services

2.1 The Company provides waste clearance and collection services, including domestic, commercial and garden waste removal, subject to these Terms and Conditions and applicable waste management regulations in the United Kingdom.

2.2 The Services will be provided at the Site agreed with the Customer. It is the Customer's responsibility to ensure safe access and adequate parking for our vehicle and team so that the collection can be carried out safely and efficiently.

2.3 The Company reserves the right to refuse to collect any items that are hazardous, prohibited, illegal or unsafe to handle, or that are materially different from the description provided at the time of booking.

2.4 While the Company will carry out the Services with reasonable skill and care, we do not guarantee that all items requested will be collected if doing so would breach health and safety rules, waste regulations, or exceed vehicle capacity.

3. Booking Process

3.1 Bookings may be made by telephone, email or online request form where available. All bookings are subject to confirmation by the Company.

3.2 When making a booking, the Customer must provide accurate information, including but not limited to:

a. The Site address and any access restrictions.

b. The approximate volume, type and nature of the Waste.

c. Any heavy, bulky or awkward items that may require special handling.

d. Any parking arrangements or permits required at the Site.

3.3 Quotations are usually given based on the volume and type of Waste described by the Customer. All quotations are estimates only and may be adjusted if, on arrival, the Waste is materially different in quantity, type or difficulty from the description provided.

3.4 A booking is considered confirmed only when the Company has accepted the booking, provided a date and approximate time window, and the Customer has accepted any quoted charges and, where applicable, paid any required deposit.

4. Access, Parking and Customer Obligations

4.1 The Customer is responsible for ensuring that reasonable access is available to the Site for our vehicle and collection team. This includes access through any communal areas, staircases, lifts or driveways as necessary.

4.2 The Customer is responsible for securing any parking permissions or permits required for our vehicle to park near the Site. Any parking charges or penalties incurred as a direct result of inadequate or incorrect information provided by the Customer may be added to the final invoice.

4.3 The Customer must ensure that the Waste to be collected is clearly identified, safely accessible, and not contaminated with hazardous or prohibited materials, unless expressly agreed in writing and compliant with relevant regulations.

4.4 If the Site is shared, communal or managed by a third party, the Customer warrants that they have the authority or permission required to instruct the Company to remove Waste from the Site.

5. Pricing, Quotes and Additional Charges

5.1 Prices are typically based on the volume and type of Waste, as well as any additional labour or time required. Prices will be communicated to the Customer at the time of booking, or upon inspection where this is required.

5.2 The Company reserves the right to amend the quoted price if:

a. The quantity or type of Waste differs materially from that described.

b. Access is more difficult than advised, requiring additional time or manpower.

c. Additional services are requested by the Customer on arrival, such as extra clearance areas or dismantling of items.

5.3 Any revised price will be discussed with the Customer before work continues. If agreement cannot be reached, the Company may cancel or partially complete the Services, and a call-out or minimum charge may be applied as set out at the time of booking.

6. Payments and Invoicing

6.1 Payment is due on completion of the Services unless otherwise agreed in writing in advance. For some bookings a deposit or pre-payment may be required to secure the appointment.

6.2 The Company accepts payment by cash, debit card, credit card, or bank transfer, subject to any limitations notified to the Customer at the time of booking.

6.3 Where credit terms are agreed for business customers, invoices must be paid in full within the agreed payment period. If no period is specified, payment is due within 14 days of the invoice date.

6.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate permitted under UK law, as well as reasonable costs of debt recovery.

6.5 All prices quoted are exclusive of VAT unless expressly stated otherwise. Where applicable, VAT will be added at the prevailing rate.

7. Cancellations and Rescheduling

7.1 The Customer may cancel or reschedule a booking by giving the Company as much notice as reasonably possible.

7.2 Where the Customer cancels a booking with less than 24 hours notice before the agreed arrival window, the Company reserves the right to charge a cancellation fee, which may include any non-refundable costs already incurred and a call-out charge to cover allocated time and resources.

7.3 If the Customer is not present at the Site at the agreed time and has not made arrangements for access to the Waste, the Company may treat this as a late cancellation and a charge may apply.

7.4 The Company may, on occasion, need to cancel or reschedule a booking due to vehicle issues, staff availability, severe weather, access problems, or other circumstances beyond our reasonable control. In such cases, we will notify the Customer as soon as practicable and arrange an alternative time. The Company will not be liable for any indirect or consequential losses arising from such rescheduling.

8. Performance of the Services

8.1 The Company will carry out the Services with reasonable skill, care and diligence and in accordance with industry practice for waste clearance and rubbish removal services.

8.2 Our team will take reasonable care when working on the Site, but the Customer should remove or protect any sensitive items or surfaces in proximity to the Waste being cleared.

8.3 Unless specifically agreed, the Company is not responsible for deep cleaning, decorating, or restoration of the area after clearance. We will leave the area swept or tidy to a reasonable standard having regard to the nature of the Waste and the condition of the Site.

9. Waste Regulations and Prohibited Items

9.1 The Company operates in compliance with applicable UK waste management and environmental regulations and will only dispose of Waste at authorised facilities or via lawful transfer routes.

9.2 The Customer warrants that the Waste to be collected does not include hazardous or prohibited materials such as asbestos, clinical waste, certain chemicals, pressurised containers, flammable substances, or any items that are illegal to transport or dispose of, unless specifically agreed in writing and fully compliant with relevant regulations.

9.3 If, during the course of the Services, we identify items that are prohibited or require specialist handling, we may:

a. Refuse to collect those items; or

b. Suspend the Services until suitable arrangements and pricing for safe handling have been agreed with the Customer.

9.4 Title and responsibility for the Waste transfers to the Company once it is loaded onto our vehicle, except where collection is refused or items are subsequently identified as prohibited or illegal. In such cases, we may return the items to the Site or require the Customer to arrange appropriate disposal.

10. Customer Representations and Indemnity

10.1 The Customer represents and warrants that:

a. They have full authority to instruct the Company to remove Waste from the Site.

b. The Waste does not include items unlawfully obtained or belonging to third parties without consent.

c. All information supplied to the Company is accurate and not misleading.

10.2 The Customer agrees to indemnify the Company against all claims, losses, damages, fines, penalties, and costs arising from any breach of these warranties, including but not limited to the inclusion of unauthorised, hazardous or illegal items within the Waste.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions shall limit or exclude the Companys liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be limited or excluded under UK law.

11.2 Subject to clause 11.1, the Company shall not be liable for:

a. Any indirect, consequential or special loss or damage.

b. Loss of profits, business, revenue, or anticipated savings.

c. Any loss or damage arising from inaccurate or incomplete information provided by the Customer.

11.3 The Companys total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Services giving rise to the claim.

11.4 The Customer is responsible for removing or securing valuables, breakables and fragile items before the Services commence. While our team will use reasonable care, we cannot accept liability for damage to items that should have been moved, protected or secured by the Customer.

12. Complaints

12.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as reasonably possible, providing full details of the issue.

12.2 The Company will investigate any complaint and, where appropriate, may offer to remedy the issue, provide a partial refund, or take other reasonable steps. Any remedies will be at the Companys discretion, subject always to the limitations of liability in these Terms and Conditions.

13. Force Majeure

13.1 The Company shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. This may include extreme weather, accidents, traffic disruption, industrial action, or failure of third party suppliers.

13.2 In such circumstances, the Company will use reasonable efforts to inform the Customer and to resume the Services as soon as reasonably practicable.

14. Data Protection and Privacy

14.1 The Company may collect and process personal data relating to the Customer in order to manage bookings, provide the Services, and process payments.

14.2 The Company will handle personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such data secure and confidential.

15. Variation of Terms

15.1 The Company reserves the right to amend or update these Terms and Conditions from time to time. The version in force at the time of the Customers booking will apply to that booking.

15.2 Any changes will normally be posted on our standard documentation or made available on request. Continued use of the Services after any amendments are made shall constitute acceptance of the updated Terms and Conditions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions will continue in full force and effect.

17.2 No failure or delay by the Company in exercising any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy.

17.3 These Terms and Conditions form the entire agreement between the Customer and the Company concerning the provision of the Services and supersede any prior agreements, understandings or arrangements.

By confirming a booking with Waste Clearance Maida Vale or allowing our team to commence the Services, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
